CASE FILE

In the early 2000s, a methamphetamine epidemic swept through rural southern Illinois. Law enforcement agencies, under pressure to produce results, began building cases on destroyed evidence, off-the-record judicial proceedings, and coordinated prosecutorial misconduct.

Michael Ray Myers was arrested in March of 2000 on a failure to appear warrant and charged with two federal counts. Every item of physical evidence was incinerated before charges were filed. From arraignment through sentencing, the record shows a pattern of suppressed motions, a fabricated court document, and six days of illegal detention.

What follows is a documented account — drawn from court filings, docket records, and public records — of how one man's life was dismantled by a system that had already decided his guilt.

The Record Speaks

Evidence Destroyed Before Charges Were Filed

On March 20, 2000, Detective Dan Stone incinerated every seized item — propane tanks, camping supplies, a CLR-soaked scale — with no chemical testing, no photographs, and no samples preserved. Michael Ray Myers was not charged until March 27.

The Ghost Hearing and the Counterfeit Document

On August 24, 2000, Myers' scheduled pretrial hearing was convened — but never placed on the public docket. Judge Gilbert personally scolded Myers for filing three constitutional motions, then buried all three off the record to protect every participant from the Brady violations being hosted on the court's own time. On September 11, Deputy Clerk Duncan manufactured Document 25 — backdated minutes for a hearing that never occurred — to cover six days of illegal detention.

Pro Se Motions Struck Without Ruling

Between November and December 2000, Michael filed four pro se motions to suppress evidence from the warrantless March 20 search. Judge Gilbert struck all four — ordering retained counsel Stegmeyer to remain on the case — before a guilty plea was entered December 21.
