CASE NO. 4:00-cr-40034-JPG — SOUTHERN DISTRICT OF ILLINOIS

The Case Timeline

A documented record of events from the March 2000 arrest through the forced guilty plea. Every entry is drawn from court filings, public records, and firsthand accounts.

BACKGROUND

Methamphetamine Epidemic Reaches Peak in Southern Illinois

Rural southern Illinois communities are devastated by a surge in methamphetamine production and distribution. Law enforcement agencies face intense political pressure to produce arrests and convictions. Informant-driven prosecutions become the primary tool — with little oversight of informant credibility or the evidence they provide.

CRITICAL EVENT

Armed Man in Tactical Black Found Snooping Around Myers' Private Property — Accidental Discharge — The True Origin of the Case

A few days before his arrest, Michael Ray Myers discovers footprints behind his house near an old dump on his private property. Upon investigating, he encounters a man crouched on the ground, dressed head to toe in solid tactical black — no badge, no insignia, no verbal identification of any kind. The man is armed. He does not identify himself as law enforcement. He does not announce himself. He says nothing. Myers draws his .410 revolver loaded with number 6 shot, orders the man to the ground, and accidentally discharges the weapon when the man refuses to comply. The wad from the shotgun shell strikes the man in the chest. He goes down. Myers takes cover. When he moves to check on the man's condition, he is gone. No warrant existed authorizing any law enforcement presence on Myers' property. No officer identified himself before, during, or after the confrontation. On March 20, 2000 — the day of Myers' arrest — a detective informs him for the first time that the man in the black fatigues was a sheriff's deputy. The meth charges that follow are the legal pretext. The actual motivation behind the prosecution, the evidence destruction, the ghost hearing, the counterfeit court minutes, and the six days of illegal imprisonment is this moment: an accidental discharge on private property against an unidentified, unmarked officer conducting an unauthorized covert surveillance operation with no warrant.

CRITICAL EVENT

Michael Ray Myers Arrested by Jackson County Sheriff's Department — All Seized Property Incinerated the Same Day

On March 20, 2000, Michael Ray Myers is arrested by the Jackson County Sheriff's Department. On that same day — before any charges are filed and before any laboratory analysis is performed — the Jackson County Sheriff's Department incinerates the entirety of the seized property. The items destroyed are ordinary household and outdoor goods: barbecue grill propane tanks, camping supplies, hunting supplies, coffee pots, and a white heavy-duty scale with visible limescale buildup that had been soaking in CLR cleaner — producing a green bubbling effect that investigators characterized as suspicious. No chemical testing is performed on any item. No photographs are taken. No samples are preserved. Detective Dan Stone documents the destruction himself, generating a list of suspected household chemicals and noting their immediate incineration — without verification, without laboratory analysis, and without any chain of custody.

CRITICAL EVENT

Re-Arrested and Brought Before Federal Magistrate — Special Agent Chris O'Reilly Presents Criminal Complaint — Held Without Bond

On March 27, 2000, Michael Ray Myers is arrested a second time and brought before a federal magistrate court. Special Agent Chris O'Reilly presents a criminal complaint to the court charging Myers with two federal counts: Count 1 — Attempt to Manufacture Methamphetamine (21 U.S.C. §§ 841(a)(1), 846), and Count 2 — Possession of Materials to Manufacture Methamphetamine (21 U.S.C. § 843(a)(6)). Both counts are built entirely on Detective Dan Stone's unverified list of destroyed household items. The actual property — propane tanks, camping gear, hunting supplies, coffee pots, and a scale being cleaned with CLR — no longer exists. It was incinerated one week earlier with no testing, no photographs, and no preserved samples. There is no physical evidence. There is no laboratory analysis. Myers is held without bond and remanded to U.S. Marshal custody pending trial.

MISCONDUCT

Case Transferred to Federal System to Exploit a Critical Evidentiary Loophole — Grand Jury Presented a List, Not Evidence

Because the Jackson County State's Attorney's Office lacked the verified laboratory evidence required to sustain a valid state-level prosecution, Detective Stone — acting as a cross-deputized DEA task force officer — transferred the legally deficient case files into the federal system. The transfer was not incidental. It was strategic. Under state grand jury rules, physical evidence must be produced. Under the federal grand jury system, no such requirement exists — a witness may simply describe items to the grand jury, and that verbal description alone is legally sufficient to secure an indictment. The prosecution exploited this loophole deliberately. Detective Stone appeared before the federal grand jury and described the destroyed items from his own written list. No photographs were shown — none existed. No chemical analysis was presented — none had been performed. No physical samples were produced — all had been incinerated on day one. The grand jury was never told the evidence had already been destroyed before a single charge was filed. They were never told there was no photograph of these items, much less a laboratory result. They were never told that investigators had made no attempt whatsoever to verify whether any of the destroyed property was actually related to methamphetamine manufacturing — because everyone involved already knew it was not. These were ordinary household items. This was not a legitimate investigation. From the moment the Jackson County Sheriff's Department lit that fire on March 20th, this case was a witch hunt — and when the state system could not sustain it, the DEA absorbed the file and transformed it into a rolling federal conspiracy designed to put Michael Ray Myers behind bars for life.

LEGAL ACTION

Defendant Files Three Written Motions — Brady Violations, Destroyed Evidence, Speedy Trial

From his jail cell, Michael Ray Myers files three written motions directly with the court. Two motions document the Brady violations in explicit detail: the pre-charge destruction of all physical evidence, the absence of any laboratory testing, the absence of photographs, and the absence of any preserved samples — establishing that the prosecution was built on evidence that no longer existed. A third motion raises the Speedy Trial violation, asserting that the mandatory statutory clock had already been exceeded. All three motions are filed in writing and submitted to the court. None receive a ruling on the open record.

CRITICAL EVENT

Off-the-Record Chambers Conference — Three Motions Disposed of in Secret

On August 24, 2000, Michael Ray Myers' scheduled pretrial hearing is convened — but it is never placed on the public docket. Present in chambers: District Judge J. Phil Gilbert, AUSA George Norwood, Detective Dan Stone, defense attorney Charles Stegmeyer, Deputy Clerk Melinda S. Duncan, and Myers himself. This is a court proceeding conducted on the court's time and funded by the American taxpayer — but it is deliberately kept off the official record to protect every participant from the Brady violations already committed. During the hearing, Judge Gilbert personally scolds Myers for filing his three written motions — the two Brady motions and the Speedy Trial motion. Those motions are never docketed. They are never ruled upon. They are made to disappear. Every person in that room understands exactly why: if those motions enter the public record and are ruled upon honestly, each of them faces federal criminal exposure. By hosting this pretrial proceeding off the docket, they are not merely suppressing a defendant's constitutional rights — they are committing those acts on government time, in a federal courthouse, with a federal judge presiding. The hearing produces no written order. It is not recorded. It does not appear anywhere in the official case file. It is a felony conducted in plain sight — shielded only by the fact that no one outside that room was supposed to know it happened.

CRITICAL EVENT

Family Arrives at Courthouse — Courtroom Occupied, Myers Not on the Docket, Trial Never Happens

Michael Ray Myers' family arrives at the Benton Federal Courthouse on September 5, 2000 for what they believed would be his trial. They find the courtroom occupied by a civil suit — Bank of Edwardsville — with a full roster of attorneys. Myers' case is nowhere on the docket. There is no trial. There is no hearing. There is no explanation. Confused and alarmed, his family goes home not knowing what has taken place — only that Michael is not in the courtroom and his case does not appear to exist that day. Meanwhile, the mandatory 70-day Speedy Trial Act clock expires at zero. No valid judicial order exists on the public docket to pause the clock. At 5:00 PM on September 5, 2000, Michael Ray Myers is legally free. The court has lost all statutory authority to hold him. He sits in his jail cell — unaware — while the law requires his release.

CRITICAL EVENT

6 Days of Secret Illegal Imprisonment by a District Judge and His Clerk

From September 5 through September 11, 2000 — six full days — Michael Ray Myers is held in a jail cell with no legal authority to detain him. The Speedy Trial Act clock has expired. The court has no valid order on the docket. He is a free man being illegally imprisoned. During those same six days, District Judge J. Phil Gilbert and Deputy Clerk Melinda S. Duncan work to manipulate the court's computer system into accepting a retroactive entry that will paper over the default. The automated system resists — it cannot be unlocked to insert a backdated entry after the default hour has passed. It takes them until September 11th to force the system to accept the falsified record.

MISCONDUCT

Melinda S. Duncan Counterfeits Court Minutes — Places Myers in a Courtroom He Never Entered

On September 11, 2000, Deputy Clerk Melinda S. Duncan manually manipulates the electronic court registry. Using a fictional 'Final Pretrial Hearing' event code to bypass automated system locks, she creates Document 25 — fraudulent court minutes backdated to September 5, 2000. The falsified minutes state that Michael Ray Myers was present in the courtroom on September 5th alongside other listed members of the court. He was not. The courtroom was occupied by a civil trial. His family was there and found no trace of his case. The document is a counterfeit. It was fabricated to steal six days of his freedom and to shield Judge Gilbert, AUSA Norwood, Detective Stone, and every other participant in the conspiracy from the automatic constitutional dismissal the Speedy Trial default required. The physical paper record is stamped September 5, 2000. The electronic network metadata — which cannot be deleted — permanently records the true entry date: Entered 09/11/2000.

EVIDENCE ISSUE

Emergency Filings Placed Under Seal — The Hidden Trigger for the Cover-Up

On September 1, 2000, specific emergency filings are placed on the docket under seal. These sealed documents constitute the hidden trigger for the rolling cover-up that follows. Unsealing them is the direct key required to expose the underlying Fraud upon the Court, unlock the complete chain of individual liability, and establish the exact mechanism used to maintain an unauthorized physical detention.

CRITICAL EVENT

Judge Gilbert Threatens Myers from the Bench — Psychiatric Commitment, New York City

On December 12, 2000 — nine days before the guilty plea — District Judge J. Phil Gilbert delivers a direct threat to Michael Myers from the bench. If Myers continues filing pro se motions with the court, Gilbert tells him, he will not remain in the federal system. He will be committed to a mental hospital in New York City. Gilbert is specific: Myers will live in a skyscraper in the middle of New York City, and he can play basketball on the roof. This is not a competency proceeding initiated in good faith. It is a threat designed to silence a defendant who has been filing motions challenging the legality of his own detention. The message is unambiguous: stop writing, or disappear. Nine days later, Michael Myers pled guilty.

CRITICAL EVENT

Guilty Plea Entered Under Duress — Count 2, 21 U.S.C. § 843(a)(6)

On December 21, 2000, Michael Myers enters a guilty plea to Count 2 of the indictment — a violation of 21 U.S.C. § 843(a)(6), knowing or intentional possession of listed chemicals with reasonable cause to believe they would be used to manufacture a controlled substance. It is not a plea freely given. By this date, the physical evidence has been destroyed, the docket falsified, six days of illegal detention concealed, his own attorney paid twice, and a federal judge has threatened him from the bench with psychiatric commitment nine days prior. Every institutional mechanism that was supposed to protect him has been turned against him. The plea is the product of a system that made a fair trial impossible.

UPCOMING

Planned Filing — Motion to Unseal — Benton Federal Courthouse

On Friday, October 30, 2026, Michael Ray Myers will travel to the Benton Federal Courthouse to file his Motion to Unseal the September 1, 2000 sealed filings pro se. The motion has not yet been filed. October 30th is the planned filing date — not a scheduled hearing. This filing will be the first formal step to compel production of the documents that triggered the cover-up and to place the full documented record of fraud upon the court before a federal judge.
